Facebook Contest Rules – 27/11/2020

1.1. Participants in the Game are obliged to comply with the present terms and rules of the Game, referred to as “Official Rules”.

1.2. The Official Rules are published on the official website of Vais Vending Ruse and will be available throughout the entire duration of the Game at: https://www.vaisvending.com

1.3. The Organizer reserves the right to unilaterally amend or supplement the Official Rules, with the amendments entering into force after their publication on the official website of ET “Valeri Velikov-Vais”, at: https://www.vaisvending.com

ET “Valeri Velikov-Vais” will terminate the participation of any participant who has stated, by sending an e-mail message to office@vaisvending.com, that they do not agree with the amendments and supplements to the general terms and conditions.

1.4. The content of the Game is accessible to every visitor of the Facebook page https://www.facebook.com/vais.vending.ruse/, but only users who have fulfilled the conditions and rules described in these Official Rules may participate in the Game.

1.5. All participants who attempt to violate or violate the Official Rules of the Game, including by applying techniques and/or using technologies that alter the mechanism of the Game, or who attempt fraud, will be automatically disqualified, unless their actions constitute a criminal offense under the Criminal Code or give rise to civil liability, in which case action shall be taken in accordance with applicable legislation.

1.6. ET “Valeri Velikov-Vais” has the right, at its sole discretion and at any time, to terminate the “Coffee with Vais” Game. In the event that ET “Valeri Velikov-Vais” terminates the Game prematurely, it shall not be obliged to award the announced prize and shall not owe compensation and/or damages to participants in the Game.

1.7. This Game is in no way sponsored, endorsed, administered by, or associated with Facebook.

1.8. ET “Valeri Velikov-Vais” shall not be liable for technical problems or disruptions preventing participants from using the Facebook page as a result of the operation of the participant’s equipment.

1.9. Each participant who joins the “Coffee with Vais” Game declares that they are aware of the possibility of interruptions and other difficulties in establishing an Internet connection and connection to the Facebook page that may occur. Participants declare that they will not claim any compensation from the Organizer for lost profits, damages or inconveniences resulting from the occurrence of the aforementioned Internet connection difficulties, including with regard to the capacity of such connection.

1.10. ET “Valeri Velikov-Vais” shall not be liable for the inability to provide participation in the Game in the event of circumstances beyond its control: force majeure, accidental events, problems in the global Internet network and the provision of services beyond the control of ET “Valeri Velikov-Vais”.

1.11. ET “Valeri Velikov-Vais” shall not be liable for loss of stored information, system failures or technical problems related to participation in the Game.

1.12. All costs related to the participant’s participation in the Game, such as access to the Internet and others, except for costs which under these Official Rules are borne by ET “Valeri Velikov-Vais”, shall be borne by the participant.

1.13. All matters not regulated by these Official Rules shall be governed by the applicable legislation of the Republic of Bulgaria.

1.14. The parties declare that if any of the clauses of these “Official Rules” is found to be invalid, this shall not result in the invalidity of the Game rules as a whole, or of other clauses or individual parts thereof. The invalid clause shall be replaced by mandatory provisions of law or established practice.

2.1. The Game is organized and conducted by ET “Valeri Velikov-Vais”, city of Ruse, 3 Pliska Street, hereinafter referred to as the Organizer.

3.1. The Game is organized electronically on the official corporate page of ET “Valeri Velikov-Vais” on the Facebook platform, at the Internet address: https://www.facebook.com/vais.vending.ruse/

4.1. All legally capable individuals over 18 years of age residing in the territory of the Republic of Bulgaria have the right to participate in the Game, with the exception of employees and workers of ET “Valeri Velikov-Vais”, its subsidiaries, as well as the families /spouses, children and parents/ of the employees/workers of the listed companies.

5.1. The Game starts at 15:00 on 27.11.2020 and continues until 23:59 on 01.12.2020.

6.1. Participation in the Game is not conditional upon the purchase/use of a product or service from ET “Valeri Velikov-Vais”.

6.2. For the purposes of the Game, three posts containing the mechanism of the Game will be published on the official Vais Vending Facebook page at: https://www.facebook.com/vais.vending.ruse/. The posts will be open for comments from 19:00 on 27.11.2020 until 23:59 on 01.12.2020.

6.3. Game mechanism – Participants in the Game must like the Vais Vending Facebook page and write, as a comment on the publication, an answer to the question: “Who do you like to drink your coffee with?”, while tagging the Facebook profile of the person concerned.

6.5. Users who submit an answer after the deadline will not be considered participants and their names will not be included in the lottery.

6.6. Users who have submitted an answer within the specified period but have not tagged the Facebook profile of the person mentioned in their answer will not be considered participants and their names will not be included in the lottery.

6.7. By accepting these Official Rules, each participant declares that their participation in the Game is entirely at their own risk and responsibility. ET “Valeri Velikov-Vais” shall not be liable for damages caused to the participant as a result of participation in the Game.

7.1. The prize for the selected winning participant is a Lavazza Blue Classy Mini coffee machine plus a box of 100 coffee capsules for the same machine. The total number of prizes for participants in the Game is: 1 /one/.

7.2. After the deadline for submitting an answer to the Game post has expired, one winning participant who has fulfilled the participation condition under item 6.3 will be selected at random from all comments under the Game publication using a special online random selection tool. The name of the winning participant will be announced in a separate post on 02.12.2020 on the official Facebook page of ET “Valeri Velikov-Vais”, at: https://www.facebook.com/vais.vending.ruse/

7.3. The Organizer shall not be liable for unclaimed prizes and shall have no obligation to seek participants who have not claimed their prize.

7.4. The prize shall be awarded in the form in which it was announced. It cannot be replaced by another prize or provided as a cash equivalent.

8.1. The prize shall be awarded to a participant who meets the present participation rules of the Game.

8.2. In order to receive the prize, the winner must provide their name and contact telephone number by sending them via private message to the Facebook page of ET “Valeri Velikov-Vais” at https://www.facebook.com/vais.vending.ruse

8.3. The prize shall be provided personally to the winner, and if this is not possible, it shall be delivered free of charge by courier to the winning participant within 10 (ten) business days after the winner is announced and the delivery address is confirmed. The prize shall be delivered to the same address only once. In the absence of the winning participant, the latter shall receive an SMS or telephone call with additional instructions regarding receipt of the prize within 10 (ten) business days. An unclaimed prize within this period shall not be awarded and shall be used in future brand promotions. Upon delivery of the prize, the winner must complete a handover protocol in 2 copies to certify receipt of the prize.

8.4. The Organizer shall not be liable to a winning participant who has provided invalid contact details.

9.1. The Organizer shall not be liable for information provided by the winner that is obviously false or misleading.

9.2. The Organizer of the Game shall not be liable if the prize cannot be delivered due to inaccurate or incomplete name, address or contact telephone number provided by the participant.

9.3. The Organizer shall not be liable for defective or unsuccessful electronic transmission of data or failure of communication links, regardless of the cause, with respect to equipment, systems, networks, lines, satellites, servers, computers or providers used in connection with the Game.

9.4. The Organizer of the Game shall not be obliged to conduct correspondence regarding claims from non-winning participants, after the expiry of the Game period or on other similar occasions.

9.5. The Organizer shall not be liable for inability to provide participation in the Game due to circumstances beyond its control.

9.10. The participant shall indemnify ET “Valeri Velikov-Vais” and all third parties for all damages and lost profits incurred, including fines paid, any expenses and attorneys’ fees paid, arising as a result of claims brought by and/or compensation paid to third parties in connection with their participation in the Game, in violation of applicable legislation and these Official Rules.

9.11. ET “Valeri Velikov-Vais” has the right, immediately and without notice, to suspend and restrict the participation of a participant when they act in violation of the law, these Official Rules, morality and good manners. This right shall be exercised by blocking the participant’s access to the Facebook page https://www.facebook.com/vais.vending.ruse as well as by removing comments published by them.

9.12. ET “Valeri Velikov-Vais” shall not be liable for damages and lost profits suffered by the participant or third parties as a result of the suspension, restriction of participation, removal or deletion, modification, loss, unreliability, inaccuracy or incompleteness of messages, materials or information transmitted, used, recorded or made available through the Internet page of the Game.

9.13. Where there are sufficient grounds to assume that the participant’s act may constitute a criminal offense, the Organizer shall notify the competent state authorities and provide them with all necessary information and materials that may assist in identifying the offender and proving the offense committed.

9.14. By accepting these Official Rules, each participant declares that their participation in the Game is entirely at their own risk and responsibility. ET “Valeri Velikov-Vais” shall not be liable for damages caused to the participant as a result of participation in the Game.

10.1. By participating in the Game, participants agree that in the event of winning a prize, their names may be published as a comment in the Game posts on the official Facebook page of Vais Vending Ruse: https://www.facebook.com/vais.vending.ruse

11.1. The prize shall be provided personally or delivered by courier to the winning person upon presentation of an identity document and signing of a handover protocol confirming receipt of the prize and may not be transferred or replaced and has no cash equivalent.

12.1. The Organizer has the irrevocable right to terminate the Game at any time by announcing this in accordance with these Official Rules in the event that abuse or mass violation of the rules is established, in the event of force majeure or for other objective reasons. In the event of abuse, bad faith or violation of the Official Rules by a participant, the Organizer has the right to disqualify them.

13.1. Pursuant to Article 16 (2) (Supplemented – State Gazette, issue 113 of 2007, effective from 01.01.2008, supplemented – State Gazette, issue 32 of 2016, effective from 01.01.2017), when determining taxable income, income subject to final taxation under this law or final taxation under the Corporate Income Tax Act, as well as income subject to patent tax and/or tax on taxi passenger transport under the Local Taxes and Fees Act, is not included.

13.2. Pursuant to Article 38, paragraph 14 of the Personal Income Tax Act

(14) (New – State Gazette, issue 98 of 2018, effective from 01.01.2019) The gross amount of taxable cash and non-cash prizes acquired from games, competitions and contests that are not provided by an employer or contracting party is subject to final tax.

13.3. ET “Valeri Velikov-Vais” shall not be liable under the Personal Income Tax Act; by participating in the Game, participants agree that this responsibility is theirs.

14.1. Any disputes arising between ET “Valeri Velikov-Vais” and participants shall be resolved through negotiations or, as a last resort, if no agreement can be reached, before the competent Bulgarian court with its seat in the city of Ruse.

15.1. Statements and notices under these Official Rules shall be considered validly made if made in the form of a letter with acknowledgment of receipt, e-mail or other similar means, provided that the statement is technically recorded in a manner allowing it to be reproduced, including pursuant to the Electronic Document and Electronic Certification Services Act.

15.2. If a participant has provided an invalid e-mail address, the statement shall be considered received solely upon its sending by ET “Valeri Velikov-Vais”, even if it has not been received.

16.1. By expressing consent to these Official Rules, the participant is deemed to have consented to the storage and processing of the data provided by them by ET “Valeri Velikov-Vais”.

16.2. Each participant has the right to access and correct their personal data in accordance with the Personal Data Protection Act.

16.3. ET “Valeri Velikov-Vais” takes the necessary care to ensure that the collection, processing and storage of participants’ personal data is carried out in strict compliance with the provisions of the Personal Data Protection Act.

16.4. ET “Valeri Velikov-Vais” is responsible for protecting the information about participants that becomes known to it in connection with the “Coffee with Vais” Game covered by these Official Rules, except in cases of force majeure, accidental events or malicious actions by third parties.

16.5. ET “Valeri Velikov-Vais” undertakes not to monitor, edit or disclose any personal information about the participant or their participation in the Game and not to provide the collected information to third parties – state authorities, commercial companies, individuals and others, except in cases where:

16.5.1. The participant has provided their explicit consent.

16.5.2. The information has been requested by state authorities or officials who, under applicable legislation, are authorized to request and collect such information in compliance with legally established procedures.

16.5.3. Information concerning personal data is provided to employees or subcontractors of ET “Valeri Velikov-Vais” for activities related to the conduct of the Game.

16.5.4. Other cases specified by law.

16.6. ET “Valeri Velikov-Vais” undertakes to provide the participant with the opportunity, by sending a notification by e-mail, to prohibit the provision of wholly or partially processed personal data for the purpose of using it for commercial information, advertising or market research.

16.7. ET “Valeri Velikov-Vais” undertakes to provide the participant with the opportunity, by sending a notification by e-mail, to prohibit the provision of wholly or partially processed personal data for the purpose of using it for commercial information, advertising or market research.

16.8. By participating in the Game, participants agree that their personal data may be used completely free of charge by ET “Valeri Velikov-Vais” for the purposes of this Game. This includes publication on the website https://www.vaisvending.com, as well as on the Organizer’s Facebook page https://www.facebook.com/vais.vending.ruse/ of the names (usernames of participants), photographs and statements of participants, which may be used for advertising the Game.
